These Terms of Use ("Terms") govern your access to and use of the websites, online ordering, delivery services, loyalty program, and in-store services of Gatsby Cannabis Co. ("Gatsby," "we," "us," or "our"). By using our site or services, you agree to these Terms. If you do not agree, do not use the site.

1. Eligibility & Age Verification

You must be at least 21 years old (or a registered Michigan medical-marijuana patient 18+) and able to present valid government-issued ID. Recreational sales are limited to adults 21+. We reserve the right to refuse service to anyone who cannot verify age or identity.

2. Michigan Law & Compliance

All transactions are governed by the Michigan Regulation and Taxation of Marihuana Act (MRTMA) and the Medical Marihuana Facilities Licensing Act. Possession limits, transport, and consumption rules apply. You agree not to resell our products, take them across state lines, or consume in public.

3. Orders, Pricing & Payment

• Online orders are reservations; final pricing, taxes, and availability are confirmed at pickup or delivery.
• Delivery requires a $50 minimum and is paid by debit card or Pay by Bank.
• Orders more than 5 miles from the dispatching store carry a $5 delivery fee.
• We may cancel any order in our sole discretion, including for suspected fraud, ID-verification failure, or stock errors.

4. Returns

Per Michigan CRA rules, cannabis products generally cannot be returned once they leave the licensed premises. Contact us promptly if a product is defective or mis-picked and we will resolve it consistent with state regulations.

5. Loyalty / VIP Program

Rewards have no cash value, may expire, and may be modified or terminated at any time. Points and discounts are non-transferable.

6. Acceptable Use

You agree not to misuse the site, attempt to bypass age gates, scrape or copy content, interfere with site operation, or use it for any unlawful purpose.

7. Intellectual Property

All site content, including the Gatsby Cannabis name, logo, photography, and copy, is owned by Gatsby or its licensors and protected by law. You may not reproduce it without written permission.

8. Disclaimers

The site and services are provided "as is" without warranties of any kind. We do not guarantee that the site will be uninterrupted, error-free, or secure. Product information is for general use and is not medical advice.

9. Limitation of Liability

To the maximum extent permitted by law, Gatsby is not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill arising from your use of the site or services.

10. Governing Law

These Terms are governed by the laws of the State of Michigan. Any dispute will be resolved in the state or federal courts located in Oakland County, Michigan.

11. Changes

We may update these Terms at any time. Continued use of the site after changes are posted constitutes acceptance.
